Terms of sale.

The conditions governing the order and delivery of the analysis service.

ARTICLE 01

Identity of the Provider

The Devis Relax service is operated by:

Hereinafter referred to as "the Provider".

ARTICLE 02

Purpose

These Terms of Sale govern the conditions of ordering, payment and provision of the services offered on the Devis Relax website.

Any order implies unreserved acceptance of these Terms of Sale.

ARTICLE 03

Description of services

Devis Relax offers in particular:

  • A free construction quote analysis
  • A paid detailed analysis
  • Analysis packs
  • Complementary services that may be offered later
  • Referral services to construction brokers or partner professionals, subject to the user's prior consent

The services offered may change at any time.

ARTICLE 04

Nature of the service

The service is exclusively an aid to understanding and decision-making.

The analysis is based on the visible and legible information contained in the documents submitted by the client.

The service does not under any circumstances constitute:

  • A technical expertise
  • A project management assignment
  • A site diagnosis
  • Legal advice
  • A validation or certification of a company
  • A guarantee regarding the future quality of the work
ARTICLE 05

Ordering

Orders are placed directly on the website.

The client must:

  • Submit the documents required for the analysis
  • Verify the accuracy of the information provided
  • Accept these Terms of Sale
  • Proceed with payment when the service is paid

The order is deemed final after payment validation.

ARTICLE 06

Prices

Prices are indicated in euros, all taxes included.

The Provider reserves the right to modify its prices at any time.

The applicable price is the one displayed at the time of the order.

ARTICLE 07

Payment

Payment is due immediately upon ordering.

Payment is made by bank card via a secure payment provider.

As of the date of writing of these Terms of Sale, payment is handled by Stripe or any other equivalent provider.

The Provider never has access to the client's banking data.

An invoice may be sent to the client upon request or made available in electronic format.

ARTICLE 08

Performance of the service

The analysis begins after receipt of:

  • The required documents
  • Payment, when the service is paid

The timeframes displayed on the site are indicative and do not constitute a contractual commitment.

The Provider is bound by an obligation of means, not of results.

ARTICLE 09

Delivery of the report

The report is provided in digital format.

It is delivered via the platform or by any other electronic means provided by the service.

The client is responsible for consulting, downloading and keeping their report.

ARTICLE 10

Client responsibility

The client remains solely responsible for:

  • The documents submitted
  • Their accuracy
  • Their legibility
  • The interpretation of the analyses
  • Decisions made following the report

The report does not replace the opinion of a qualified professional.

ARTICLE 11

Limitation of liability

The Provider cannot be held responsible for:

  • The quality of the work carried out
  • Defects
  • Disputes with a company
  • Work delays
  • Budget overruns
  • Financial losses
  • Erroneous information in the documents submitted

Analyses, observations and recommendations are provided for informational purposes.

In any event, the Provider's liability is limited to the amount actually paid for the service concerned.

ARTICLE 12

No guarantee of results

The analysis is performed solely from the elements visible in the documents submitted.

The Provider does not guarantee:

  • The exhaustiveness of the analysis
  • The absence of risks related to the project
  • The future compliance of the work
  • The absence of disputes with a company

The service is exclusively a decision-making aid.

ARTICLE 13

Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, the client has a legal withdrawal period of fourteen (14) days.

However, in accordance with Article L221-28 of the French Consumer Code, the client expressly acknowledges and accepts that the performance of the service begins immediately after their order.

By validating their order, the client:

  • Requests the immediate performance of the service
  • Expressly waives their right of withdrawal once the report has been delivered
  • No refund may be claimed after full delivery of the report

The client acknowledges having been informed that the delivery of the digital report entails the loss of their right of withdrawal once the service has been fully performed.

ARTICLE 14

Complaints

Any complaint may be addressed to: info@link-travaux.fr

The Provider undertakes to review any request within a reasonable time.

ARTICLE 15

Consumer mediation

In accordance with Articles L611-1 et seq. of the French Consumer Code, the client may use a consumer mediator free of charge in the event of an unresolved dispute.

The contact details of the competent mediator will be specified on the site as soon as the Provider has joined a mediation scheme.

ARTICLE 16

Personal data

Personal data collected as part of orders is processed in accordance with the Privacy Policy available on the site.

ARTICLE 17

Intellectual property

The analysis reports, content, methods, texts and elements of the Devis Relax service are protected by intellectual property law.

Reports are reserved for the client's personal use.

Any reproduction, distribution, commercialization or exploitation without prior written authorization is prohibited.

ARTICLE 18

Force majeure

The Provider cannot be held responsible in the event of force majeure within the meaning of French legislation and case law.

ARTICLE 19

Applicable law

These Terms of Sale are governed by French law.

The reference language is French.

In the event of a dispute, the parties will first seek an amicable solution.

Failing an amicable agreement, the French courts will have sole jurisdiction.
